Ohio State Attorney Dave Yost has sued the Biden administration. It is over it’s $1.9 trillion Corona Virus (COVID-19) relief package. It was signing in effect last week. This occurred as deposits began hitting the bank accounts of many Americans.

Lieutenant Governor Jon Hustead Joins Yost in Solidarity

Ohio Lieutenant Governor Jon Husted has voiced his support for AG Yost’s lawsuit. The writing states: “the precedent Congress is attempting to set here is that anytime the federal government spends money to state or local governments. Then they could add strings to control the tax policies of all 50 states. This is both arrogant and unconstitutional.” 

Potential Withholding Needed Federal Funds from Ohio

Yost said he has filed a motion for a preliminary injunction against part of the American Rescue Plan Act. This release was sending out last Wednesday. The motion states “threatens to withhold needed federal funds from Ohio in an effort to handcuff the state’s authority to make changes to its tax structure and economic policy.” In fact, Yost says he is seeking to bar the enforcement of the “Tax Mandate,” a key provision that he claims exceeds the authority of Congress.

“In fact, the federal government should be encouraging states to innovate and grow business, not, therefore, hold critical relief funding hostage to its preferred pro-tax policies,” Yost has said in the release.

As part of the relief package, Ohio is supposed to receive $5.5 billion. It is part of the relief package. Moreover, Yost is claiming that the Tax Mandate “forces Ohio and every other state to accept that money with major conditions.” These include funds that cannot be using, directly or indirectly, to offset tax cuts or credits. That what Yost says “presents states with a choice to either accept the stimulus funds or keep their sovereign authority to reduce taxes.”

Handcuffing Ohio and Adds to the Public’s Lack of Trust in the Government

“Moreover, slipping in last-minute conditions into a plan. This is meant to help people but that instead handcuffs Ohio. That is why people don’t trust government,” Yost said. “Therefore, it almost always leads to constitutional mischief.”
